What is Review Petition? There are specific grounds to file a review petition. These grounds have been laid down through different judgements of Supreme Court Ruling. Grounds to file Review Petition • Discovery of new and important matter of evidence which after the exercise of due diligence, was not within knowledge of petitioner or could not be produced by him. • A mistake or error apparent on the face of record • Any sufficient reason analogous to above 2 provisions. REVIEW PETITION • A review petition must be filed within 30 days of the pronouncement of judgement • Any person aggrieved by ruling can seek review i.e. not just the parties to the case. They are usually not heard in the open court (except death penalty) • Lawyers make written submissions and not oral arguments. • The same judges who heard the original case, usually hear the review petition as well. LAWS ON ACID ATTACK Watershed Year A separate clause added to IPC: Section 326A Minimum Imprisonment of 10 years, extendable to life + Fine Imprisonment up to one year for denial of treatment Imprisonment up to 2 years for dereliction of Duty by police officers MHA also issued advisory to ensure speedy justice Model Poisons and Sales Rules 2013 under The Poisons Act 2013 LAW TO TACKLE ACID ATTACKS • In 2013 Supreme Court passed an order on sales of corrosive substances. • Taking note of this order, the Centre legislated Model Poisons and Sales Rules 2013 under “The Poisons Act 2013” • States were advised to legislate their own regulations as this matter was under the power of State Governments. Model Poisons and Sales Rules 2013 • Over the counter sale of Acid could take place only if vendor was maintaining a detailed log containing details of the buyer. • Educational Institutions, research labs, etc. were required to maintain a register of Usage and file the same with SDM. Important Provisions REHABILITATION • Victims are paid compensation of at least Rs 3 Lakh as after care and rehabilitation cost. • Out of 3 lakh, Rs 1 Lakh is to be paid out within 15 days of occurrence of incident to facilitate immediate medical attention. • The balance sum of Rs. 2 lakhs is to be paid “as expeditiously as may be possible and positively within two months thereafter”. COMPENSATION TO VICTIMS • States are supposed to ensure that treatment provided to acid attack victims in any hospital, public or private, is free of cost. • The cost incurred on treatment is not to be included in the Rs 1 lakh compensation given to the victim. REHABILITATION • As per the advisory of Ministry of Home Affairs, 1-2 beds at the Apex State Tertiary Hospital could be earmarked for the treatment of acid attack victims • Private hospitals which have availed the facility of concessional land for setting up the hospital could also be persuaded to earmark 1-2 beds for treatment of underprivileged victims of acid attacks MEDICAL CARE CRITIQUE OF LAW • Regulations on acid sales largely help in tracking the accused and not so much in prevention. • Implementation is not very strict. • Online availability of such products warrants a review of the law to plug the loophole.
